Your Rights Under the Contract

Through collective bargaining, the Union has won a contract containing many workplace rights.  But those rights are only as effective as our knowledge and ability to enforce them. 

Below are some highlights of your rights under the Contract.  Make sure to read the full Contract to see all of the rights it contains! 

Job Security

Under the Union Contract, non-probationary employees may only be disciplined or discharged for “just cause.”  (Most non-Union employees are “at-will,” which means they have no job security; they can be fired at any time for any reason or no reason.)

The Contract requires the University to provide, at least five days before discharging or suspending an employee for more than five days, the employee with written notice of its intent to impose discipline and the reasons for the discipline. The employee has the right to respond to the charges, orally (at a “Skelly” hearing) or in writing.

If the University issues the discipline, the Union may file a grievance.  If the grievance is not resolved informally, the Union may demand a hearing before a neutral arbitrator, who issues a final and binding decision.  If the arbitrator rules that the discipline was without just cause, s/he may order that the grievant be reinstated and provided lost wages and benefits.

Wages and Benefits

The Contract provides for significant increases in wages and medical and retirement benefits.  It also entitles employees to paid vacationsick leave, and holidays.

Non-Discrimination and Fair Treatment

The Union Contract provides that employees shall be free from discrimination based on race, color, religion, marital status, national origin, ancestry, sex, sexual orientation, gender orientation, pregnancy, physical or mental disability, medical condition (cancer-related or genetic characteristics), age, citizenship, political affiliation, union activity or service in the uniformed services.  

Employees have the right to fair and respectful treatment.  University representatives must treat employees with dignity and respect, and are prohibited from engaging in persistent bullying and significant disruptive behavior, including yelling, profanity, vulgarity, and/or verbal abuse that results in a persistently intolerable work environment.

Leaves of Absence

The Union Contract provides the right to take leaves of absence for various purposes, including

-      family care

-      medical leave

-      pregnancy disability

-      long-term disability

-      military leave

-      military caregiver

-      personal leave of absence. 

The Contract also provides for leave with pay for

-      jury duty

-      voting

-      blood donation

-      administrative or legal proceedings

-      certain emergencies

-      certain University functions.
