PERB Orders UCSD Health to Conduct Missed Equity Reviews for AO2s

Retroactive Equity Payments to Include 7% Annual Penalty

A judge with the Public Employment Relations Board (PERB) has agreed with our October 2020 complaint that UC San Diego Health unlawfully denied pay equity reviews to newly accreted Administrative Officer 2 (AO2) workers. The judge also found that UCSD discriminated against Teamsters-represented workers and interfered with employees’ right to be represented by Local 2010!

PERB based the decision on evidence presented by our Union that showed the University made a unilateral change in working conditions without bargaining in good faith with our Union over the change. The University claimed they have suspended pay equity reviews when salary negotiations are underway for newly accreted classifications since 2012, therefore it wasn’t a change in the process.

The decision orders that:

  • UCSD must process AO2 pay equity increase requests received between Oct. 5, 2020, and the date that AO2 salary negotiations were completed on Feb. 28, 2022.
  • Increases approved through the equity review process should be retroactive to the request date and add an annual 7% penalty to the total amount.
